First-Time Buyers: Do You Need a Solicitor or a Conveyancer When Buying a House?
People buying their first home often ask whether they need a solicitor or a conveyancer, and what the difference is between the two. This is a common question, particularly for first-time buyers who are navigating the property process for the first time.
In a recent video shared during First Time Buyers’ National Home Buying Week, Sam Finn, Trainee Solicitor in our Conveyancing team, explains the difference between a solicitor and a licensed conveyancer, and how both can support property transactions.
What is the difference between a solicitor and a conveyancer?
A solicitor is a fully qualified lawyer who has completed extensive legal training and is regulated by the Solicitors Regulation Authority (SRA). Solicitors are able to practise across many different areas of law, including property law, family law, litigation and private client work.
A licensed conveyancer is a specialist property lawyer who focuses specifically on conveyancing and property related transactions. Licensed conveyancers are regulated by the Council for Licensed Conveyancers (CLC).
Both solicitors and licensed conveyancers are qualified to handle property purchases, sales and remortgages.
Why do the titles differ?
The different titles reflect the type of legal qualification and regulatory body involved.
Solicitors complete a broader legal qualification which allows them to practise in multiple areas of law. This means they can often assist with a wider range of legal matters that may arise alongside a property transaction.
Licensed conveyancers follow a specialist training route focused specifically on property law and conveyancing.
Both professionals are regulated legal practitioners and both must meet professional standards set by their respective regulators.
What does this mean for buyers?
In practical terms, both solicitors and licensed conveyancers are able to carry out the legal work required to buy or sell a property. The choice often depends on the structure of the firm and the type of service offered.
