Buying or Selling a Property? Why Being Open During Conveyancing Matters
A recent court case reported by Today’s Conveyancer has highlighted the importance of clear and honest communication when buying or selling a home.
The case involved owners of a leasehold property in London who became involved in a dispute concerning information disclosed during the sale of their property, including historic complaints and issues affecting the building.
The dispute centred around information provided in standard conveyancing forms, including the TA6 Property Information Form and the LPE1 Leasehold Information Form. These are forms sellers and management companies complete during the sale process to provide buyers with important information about the property.
The dispute concerned whether information relating to historic complaints, disputes and building issues had been appropriately disclosed during the conveyancing process.
The sellers argued that information disclosed in the LPE1 and related conveyancing documentation discouraged prospective buyers from proceeding with the purchase. The matter later resulted in lengthy and costly court proceedings. Reports state the litigation ultimately left the couple facing legal costs reportedly totalling around £180,000. While every case depends on its own facts, the matter highlights how important accurate and transparent information can be during the conveyancing process.
During the conveyancing process, sellers are asked practical questions about the property so buyers can make informed decisions before committing to a purchase.
For example, sellers may be asked whether there have been:
• Disputes with neighbours
• Problems with parking or access
• Complaints about the property
• Building works or alterations
• Issues involving management companies or service charges
• Concerns affecting shared or communal areas
These forms are intended to help buyers make informed decisions and reduce the risk of misunderstandings or disputes later in the transaction.
Importantly, this does not mean sellers need to panic about every small issue or provide unnecessary information. In many cases, matters can be explained very simply with the support of a conveyancing solicitor. The important thing is to answer questions honestly and speak with your solicitor if you are unsure about anything.
