How Can Legal Advice Help Strengthen a SEND Tribunal Appeal?
Parents preparing for a SEND Tribunal appeal sometimes ask whether legal advice is helpful, particularly as the Tribunal system was originally designed to be accessible and parent-friendly.
@watkinssolicitors.sen Do parents need legal advice for a SEND Tribunal appeal? In this video, Beverley Watkins, Managing Partner at Watkins Solicitors, explains how legal advice can help parents feel more confident and prepared when bringing a SEND Tribunal appeal. SEND Tribunals were designed to be accessible for parents, but in reality, the process can feel complex and highly structured. There are legal tests to meet, formal procedures to follow and clear expectations around evidence and arguments. For many families, this can be overwhelming. Beverley explains how legal advice can help by: Clarifying what the Tribunal will be looking for Explaining how the appeal process works in practice Helping parents understand what evidence is most relevant Supporting parents to present their concerns clearly and effectively Legal advice is about helping parents understand what is expected at each stage and approach the appeal with greater confidence. In a recent video on our Education Law TikTok channel, Beverley Watkins, Managing Partner at Watkins Solicitors, addresses this question and explains how legal advice can help parents feel more confident and better prepared before an appeal.
SEND Tribunals and the reality of the process
Beverley explains that when SEND Tribunals were first introduced, they were intended to be less formal and less legalistic, so that parents could represent themselves more easily.
In practice, however, SEND Tribunal appeals can feel quite legal in nature. There are set procedures, legal tests that must be met, and expectations about how evidence is presented and arguments are structured. For many parents, this can feel overwhelming, particularly when they are already dealing with the stress of supporting a child whose needs are not being met.
Why legal advice can be helpful
Legal advice can help parents understand how a SEND Tribunal appeal works in practice, including:
- What the Tribunal will be looking for
- How the appeal process is structured
- What evidence is likely to be most relevant
- How arguments should be framed within the legal framework
This advice can help parents feel clearer about what they are being asked to do and how best to present their child’s case.
Supporting parents
Beverley emphasises that the aim of legal advice is not to make the process more intimidating. It is about helping parents understand the format of an appeal, what is expected at each stage, and how to approach the hearing with greater confidence.
For some families, a small amount of advice at the right time can make a significant difference to how prepared they feel and how effectively their concerns are communicated.
Support with SEND Tribunal appeals
Our Education Law team regularly supports parents at different stages of the SEND Tribunal process, including advising before an appeal is lodged, helping parents prepare evidence, and supporting families through hearings where needed.
We focus on clear explanations, practical guidance and helping parents understand their options, so they can make informed decisions about how they want to proceed.
